VEHICLE RECALLS
The National Traffic and Motor Vehicle Safety Act gives the Department of Transportation's National Highway Traffic Safety Administration (NHTSA) the authority to issue vehicle safety standards and require manufacturers to recall vehicles that have safety defects or do not meet Federal Safety Standards. Consumer complaints and common repairs for a particular year, make and model are considered by NHTSA to determine whether a defect trend may exist.
If a recall is issued, the manufacturer must file a public report describing the safety-related defect or noncompliance with a Federal motor vehicle standard, as well as other information. NHTSA monitors each recall to make sure of compliance by the manufacturers. Manufacturers must attempt to notify owners of recalled items.
Problems that are being investigated for a recall, or that are subject to a recall, may indicate that a vehicle has a substantial defect under the California Lemon Law.
